Town Hall studies purchase of 62 flats on calle Sarmiento

-

The Urbanism councillor and technical staff of Manilva held a meeting on Tuesday with representatives of PAH Chiclana and with tenant families from the block of flats at calle Sarmientos number 2. The aim of the meeting was to address the legal and planning situation of the building, as well as the possible courses of action open to the local administration.

According to what was explained at the meeting, it is expected to become clear in the coming days whether Manilva Town Hall will call a council meeting to debate and, if appropriate, approve the exercise of the right of first refusal and retraction (derecho de tanteo y retracto). This legal mechanism would allow the council to acquire ownership of the building’s 62 flats for less than 15,000 euros per unit, according to the estimates given.

At the same time, a technical report is planned on an alleged breach of planning regulations by the building’s construction company, in relation to the obligation to provide green spaces proportionate to the floor area built. In addition, a surveyor and an architect will take measurements to determine the actual square metres built on each floor of the building.

The purpose of this technical work will be to check rigorously whether the figures for built surface area match those officially declared and whether, as a result, the corresponding fees and taxes have been paid correctly, both to the Tax Agency and in the municipal property tax (IBI).

Another aspect to be examined is the consistency between the documentation submitted to the state auction body and the registered properties included in the auction closing certificate dated 29 May 2023, the award of which was approved by the court and notified on 10 April 2025.

The affected families have expressed their concern at the possibility that a court ruling could lead to the building being taken over and the eviction of those living in the flats, garages and storage rooms currently occupied. The proceedings are being heard at Court of First Instance no. 1 of Estepona, and the groups involved are calling for all the necessary technical reports and certificates to be taken into account in the process, as well as the contractual situation of the tenants, some of whom had rental contracts that could be renewed.
