Faced with the legislative change approved by the Spanish Government, which directly affects almost all of the employed staff of Manilva Town Hall itself, the Works Council, supported by the 3 trade unions that make it up, CSIF, CCOO and UGT, issues the following statement:

Following the new legislation recently approved by the Spanish Government, town halls and other public administrations may not have more than 8% permanent employed staff on their payrolls (8 workers out of every 100). This is the situation in which all of us find ourselves.

With Law 20/2021 coming into force at the end of December, town halls are required to convert at least 92% of their workforce into civil servants. As a result, all posts held by permanent employed staff must be put out to «concurso (merit-based selection), concurso/oposición (merit-based selection plus exam) or oposición (exam)» before 2024, and those workers who do not pass the tests will be dismissed.

In turn, this new Law allows these tests to take the form of a concurso only, thus avoiding the exam and increasing the guarantee for workers who are occupying the post on an interim basis, as is our case.

To qualify for this «concurso only» format, the public employment offer (OPE) must have been published in the relevant Official Gazette before 1 June 2022. Otherwise, we will have to fight for our jobs through competitive exams with no advantage whatsoever over the other candidates.

Drawing up and publishing the public employment offer is a complex process which requires a certain amount of time and the collaboration of various parties, namely: the governing team, the Works Council, the Comptroller, the Secretary, Human Resources, etc.

Three months after this Law was approved, we have made very little progress in drawing up the employment offer. A negotiating table was set up to work on it, but it has met only 3 times despite the Works Council’s insistence, the first time being to create this negotiating body, and only one of those meetings was attended by the Town Hall’s lawyer. The national civil servants with official accreditation never attended on any occasion, although their presence and collaboration are essential for the offer to be drawn up correctly and for legal errors to be avoided.

The main objective of this Works Council is to achieve the stabilisation of all the permanent non-tenured employed workers who form part of the municipal workforce. We therefore want to address the stabilisation of all workers with sufficient guarantees that we will not lose our jobs, by applying Law 20/2021, which, as we have said above, allows staff to be converted into civil servants without an exam.

This Works Council, with the support of the three trade unions that make it up, will continue to work hard to achieve this, but we depend entirely on political will. It is not in our hands but in those of the governing team, and so, through this statement, the Works Council wishes to distance itself in the eyes of the workers from any future setbacks that make it impossible to publish the OPE before 1 June.

We will shortly call a workers’ assembly to provide information on the matter.
