Faced with an attempt to postpone the trial yet again, with a request for suspension from the defence of the former mayor of the town, Antonia Muñoz, who submitted a written application to the court asking it to consider the preliminary question of lack of jurisdiction, arguing that the continuing offence of prevarication could carry sentences that could exceed ten years of special disqualification and that, as a result, jurisdiction to try the case would lie with the Provincial Court and not the Criminal Court, judicial sources close to the case confirm that the proceedings will continue and therefore, tomorrow, those summoned will have to appear at Criminal Court number 6 in Málaga.
Among those summoned, in addition to Muñoz and her husband, V.C.S., will be the current mayor, Mario Jiménez Rodríguez, and the current councillor for cleaning, Francisca López; the former mayors Diego Urieta Jiménez and Emilio López Berenguer; and the former councillors for Cleaning, Fishing and Resources, Antonio de Haro Fernández and Diego Díaz Jiménez, respectively.
Most of the defendants, except Berenguer, of the Agrupación Socialista de Manilva (ASM), were members of IU and created Compromiso Manilva when the left-wing coalition, five years after the political scandal broke, forced their move to the Non-Attached Group in mid-2013. This party currently governs the municipality with the support of Diego José Jimenez of the PSOE, who is precisely the main witness in this case.
