The legal team of the former mayor of Manilva, Antonia Muñoz, has asked for the trial scheduled for tomorrow, Friday, at Criminal Court no. 6 in Málaga to be suspended due to lack of jurisdiction, arguing that, given the sentence that could be sought for a continuing offence of misuse of public office (prevaricación), she should be tried by the Provincial Court.
Her lawyer, Oscar Chicharro Arcas, has submitted a written request to the court asking it to admit the application and to consider the preliminary question of lack of jurisdiction, according to Efe. Chicharro Arcas states that a continuing offence of prevaricación can carry penalties of more than ten years of special disqualification and that, as a result, the Provincial Court, and not the Criminal Court, would have jurisdiction to try the case.
We recall that on 29 October this same lawyer was the reason for the suspension of the trial, as he was on sick leave following a road accident on 14 September and had not been able to recover in time for the scheduled hearing.
The trial is set for this Friday and the mayor, Mario Jiménez, is also expected to take a seat in the dock, along with councillor Paqui López and former mayors Diego Urieta and Emilio López Berenguer, among other defendants and witnesses.
