Malaga Administrative Court number 7 has issued an order suspending mayoral resolution no. 2020/0261 of 6 February 2020, which we first reported on from this newsroom, concerning the appointment of G.S.V. to the post of general supervisor (encargado general) to replace A.M.M. At the same time, it orders the suspension of mayoral resolution no. 2020/374 of 14 February 2020, which halted the payments the replaced employee had been receiving under the «Electricity and emergencies availability agreement».
An appeal (Recurso de Apelación) may be lodged against this ruling, with no suspensive effect.
We recall that, according to the decree in question, the terms for the selection process were published on 5 December on the Town Hall noticeboard and were displayed for 15 days. However, this newsroom was unable to access the call, and despite constantly reporting on all job offers available in our municipality, we were not aware of it until the date of the resolution.
According to the decree signed at the time by the mayor, Mario Jiménez, the discrepancies that arose during the processing of the file, and using the powers granted to him by the legislation in force, in particular article 21.h of Law 7/1985 of 2 April, Regulating the Bases of Local Government, he resolved to annul the call for the filling, by free appointment, of a vacant post at Manilva Town Hall with the position of Encargado General, and to publish this Resolution on the Manilva Town Hall electronic office, so that all candidates could know its content, with a report to the council meeting still pending.
