Over recent months, concerts have been held regularly (specifically in the street, not inside the premises) at the Garum bar, located on avenida de La Paz in San Luis de Sabinillas, causing constant disturbance to residents of Jardines de Sabinillas. They have expressed their discontent to the owner on several occasions, but she has ignored them and continued with the musical activity.
Given this situation, the Local Police have been contacted on multiple dates, and their various responses have been: not attending the premises in question, attending while the event continues indoors, and attending and stating that they can do nothing because the Town Hall does not provide them with sound level meters… They have passed responsibility to the Trade and Consumer Affairs department, whose head is Noelia Muñoz López.
These events were brought to the attention of the Nivassa administration, which manages the affairs of the Jardines de Sabinillas community of owners. This company has telephoned the councillor for Trade and Consumer Affairs on numerous occasions, and she in turn referred the problem to the Local Police. And so it has gone for months…
Given the ineffectiveness of these various channels, Nivassa has asked Manilva Town Hall, by means of a general petition with a registered entry, to address the residents’ complaints. This document requests the licence granted to the Garum bar, and also the municipal ordinance governing such events and premises. A month later, the Mayor’s Office has not seen fit even to reply and give the residents the relevant information, let alone take action. The latest development is that, in a telephone conversation with the Nivassa administration, the head of Trade and Consumer Affairs announced that the owner of the Garum bar would continue to hold more concerts… The most recent took place this very Saturday, 20 April, when the Local Police did attend after the residents’ warning.
It should be understood that the disturbance is not only the excessive volume of the loudspeakers set up in the street, with the corresponding noise pollution. The premises also make improper use of public spaces, as the improvised dance floor is the pavement, which blocks passage along it to reach the homes, and one of the loudspeakers is placed close to the entrance of the nearest block. These actions undermine the right to rest, breach noise regulations and show negligence in municipal duties.
Es inconcebible que el ayuntamiento no haga nada por el descanso de los vecinos, teniendo la policía y los vecinos no tener el descanso necesario por lo cumplir las leyes el bar o lo que sea y las autoridades no hacerlas cumplir….desmoralizador.
