Marcos Ruiz, councillor for the Urbanism department, has made resolving the regularisation of scattered homes one of his priorities since taking charge of that area.
This matter, which is very important for the urban development of our municipality, will be discussed tomorrow at the ordinary council meeting.
Planning legislation requires the «restoration of legality» in respect of buildings that are manifestly incompatible with the planning regulations, but at the same time recognises the possibility of an exception to mandatory demolition where those buildings are completed, respect the environment and have a certain age.
To this end, Decree-Law 3/2019, of 24 September, on urgent measures for the environmental and territorial adaptation of irregular buildings in the Autonomous Community of Andalusia, establishes 2 routes:
– Special Plan. For groups of homes, of which Manilva has 2 instruments of this type being processed: El Hábitat rural de La Vega and the integration zone 2 on the road between Manilva and the Instituto Las Viñas.
– The «declaration of assimilation to out-of-planning status» (SAFO), for isolated homes. The law requires town halls to verify that those buildings meet minimum conditions of health and safety, and that the negative impact of the building on the surrounding landscape is avoided as far as possible.
The technical team of the Manilva Urban Planning Office has studied these issues, resulting in the drafting of an internal interpretative instruction agreed by the whole team. This instruction was reported to the ordinary council meeting of 5 August 2021. The aim has been to set, for the processing of SAFO applications, a series of criteria that are understandable and transparent for any resident.
Mario Jiménez, mayor of Manilva, who wished to highlight the great work being carried out in Urbanism, said: «One of our priority objectives is for our residents to have their homes regularised, because this will also mean that our urban development is in line with what we want for Manilva: a municipality that progresses with common sense, without overcrowding and respecting our idiosyncrasy.»
